1. Acceptance of Terms
By accessing or using Notenus (the "Service"), available at notenus.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. Notenus is an independent service operated by Notenus ("we," "our," or "us").
2. Description of Service
Notenus provides a secure, zero-knowledge cloud notepad service that allows users to:
- Create and edit text notes with custom or auto-generated URLs.
- Protect notes with AES-256-GCM client-side encryption and password protection.
- Share notes publicly or privately via unique links and QR codes.
- Access version history and restore previous versions of notes.
- Browse and discover public notes through the Explore page.
3. User Accounts
3.1 The Service can be used without creating an account. Anonymous users can create, edit, and share notes freely.
3.2 Optional account registration is available through our OAuth authentication system. By creating an account, you agree to provide accurate information and maintain the security of your credentials.
3.3 You are responsible for all activity that occurs under your account or through notes you create, whether or not you are signed in.
4. Acceptable Use
You agree not to use the Service to:
- Post, store, or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
- Distribute malware, viruses, or any other harmful software or code.
- Infringe upon the intellectual property rights of others.
- Engage in phishing, spam, or any form of unsolicited communication.
- Attempt to gain unauthorized access to other users' notes or accounts.
- Use automated tools to scrape, crawl, or extract data from the Service beyond what is permitted by robots.txt.
- Interfere with or disrupt the Service or servers connected to the Service.
- Use the Service for any illegal purpose or in violation of any applicable laws or regulations.
5. Content Ownership & Responsibility
5.1 You retain full ownership of all content you create on Notenus. We do not claim any intellectual property rights over your notes.
5.2 By creating a public note (without password protection), you grant Notenus a non-exclusive, worldwide, royalty-free license to display, distribute, and make your content available through the Service, including in search engine results and the Explore page.
5.3 You are solely responsible for the content you create and share. Notenus does not pre-screen or monitor user content but reserves the right to remove content that violates these Terms.
5.4 For password-protected notes, due to our zero-knowledge architecture, we cannot access or review the encrypted content. You bear full responsibility for any content stored in encrypted notes.
6. Custom URLs
6.1 Custom URL slugs are assigned on a first-come, first-served basis. We do not guarantee the availability of any particular URL.
6.2 We reserve the right to reclaim or reassign URL slugs that violate these Terms, infringe trademarks, or are deemed inappropriate.
6.3 URL slugs may contain only letters, numbers, hyphens, and underscores, and must be between 1 and 100 characters in length.
7. Encryption & Password Protection
7.1 Notenus provides AES-256-GCM client-side encryption as a feature. Encryption and decryption occur entirely in your browser.
7.2 We do not store, transmit, or have access to your encryption passwords. If you lose your password, we cannot recover your encrypted content. You acknowledge and accept this risk when using password protection.
7.3 While we implement industry-standard security measures, no system is 100% secure. We do not guarantee that the encryption cannot be compromised through vulnerabilities in your browser, device, or network.
8. Service Availability
8.1 We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
8.2 We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOTENUS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO NOTENUS IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.
10. Indemnification
You agree to indemnify and hold harmless Notenus, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your content, or your violation of these Terms.
11. Termination
11.1 We may terminate or suspend your access to the Service at any time, with or without cause, with or without notice.
11.2 You may stop using the Service at any time. You may delete your notes and account data through the Service interface.
11.3 Upon termination, your right to use the Service will immediately cease. Provisions that by their nature should survive termination shall survive.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of significant changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes your acceptance of the modified Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation, and if necessary, through binding arbitration or in the courts of competent jurisdiction.
